What A Florida Driver Needs To Know About Florida's Move Over Law

Many drivers are under the mistaken impression that Florida Statute §316.126, commonly known as Florida’s Move Over Law, gives them the option of either changing lanes or reducing their speed to 20 mph below the posted speed limit when an emergency vehicle is displaying visual signals while parked on the side of the roadway. The Ticket Eagle offices have recently been flooded with calls from irate drivers who have received citations for violations of this law and wonder how exactly the police officer was able to determine their rate of speed when he or she was clearly engaged in an activity that prevented them from using a radar detector. The answer is simply that the statute only allows a driver to slow down as a last resort. If a driver has room to change lanes, or move over, and fails to do so, they are in violation of the statute regardless of their rate of speed.

If you receive a Florida traffic ticket for a violation of Florida's Move Over Law, get a free consultation from a Florida traffic ticket attorney at The Ticket Eagle by calling 954-452-7911 or by filling out one of the information boxes on this website.
