I just received a non-criminal traffic ticket. What are my options?
When receiving a non-criminal traffic ticket, you can either fight the ticket, pay the ticket, or elect driving school.
My record is spotless; why not just pay the ticket?
When you are cited with a moving violation, paying the ticket will result in points being placed on your driving record. This can result in significant increases to your insurance premiums. All other circumstances being equal, a driver with only one ticket in the past few years who chose to pay that ticket is likely paying a higher premium than a driver with three tickets during that same timeframe who chose to fight their tickets.
I don't get many tickets. Shouldn't I just choose school?
It depends. In Florida, a driver may only elect to attend driving school once in a twelve month period and five times in their lifetime. In order to best protect your record, the only reason to use one of these elections is if the nature of your ticket is such that you can realistically expect to get points on your license by fighting it. Otherwise it's best to save the election for when it can be most beneficial. As mentioned in response to a previous frequent question, not all tickets are created equal. For example, if you rarely get a ticket, it is generally not very difficult for an attorney to keep points off of your driving record if you are issued a ticket in the Tri-County Area (Dade, Broward, or Palm Beach). However, this is not true for all counties throughout the state. In fact, there are several counties where a driver is very likely to get points for fighting a ticket, even if it's the only ticket that they've ever received. If a driver elects school in response to a ticket issued in the Tri-County area, and then receives a second ticket in a less friendly county within the following twelve months, they will have no choice but to risk getting points by fighting the ticket in the more difficult jurisdiction because the driving school election will be unavailable to them. Because every ticket is unique based upon a person's driving record and the county where the ticket was issued, you should speak with an attorney before deciding if driving school is the right option for you.
What are the benefits to hiring an attorney as opposed to defending the ticket myself?
One of the primary benefits of hiring an attorney to defend your traffic ticket is that an attorney gives you the best chance at getting the ticket dismissed, in which case you would not get points on your driving record or be responsible for any court costs. A common misconception is that tickets only get dismissed if the police officer fails to appear in court. In fact, many tickets are dismissed for reasons wholly unrelated to an officer's appearance in court, including technical defects on the ticket itself and insufficient evidence. The only way to ensure that these other avenues to dismissal are fully explored is to hire an attorney. One other significant benefit to hiring an attorney is convenience. Fighting your ticket on your own may require as many as three court appearances, each of which can take several hours door-to-door. The cost of hiring an attorney pales in comparison to the hassle of making numerous treks to the courthouse and the loss of income from taking time off from work to do so.
Will I need to travel to your office?
No. One of the biggest benefits to hiring The Ticket Eagle is allowing you to turn the matter over to us without having to leave your home.
